What is family petition?

Submitting Form I-130, Petition for Alien Relative, is the first step to help an eligible family member apply to immigrate to the United States and obtain a green card. The submission or approval of this petition does not grant your relative any immigration status or benefits.

Applying for an immigrant visa based on family ties is the first step in the immigration process for the person sponsored by you to become a legal permanent resident of the United States. This process is also known as family reunification.

There are two main categories of relationships that qualify for these types of immigrant visas:

  • Immediate relative. This category has an unlimited number of visas for close relatives of US citizens, such as spouses, unmarried children under 21, and parents.
  • Family preference. This category allocates a limited number of visas annually for:
  • Other relatives of US citizens, such as married children, siblings, or cousins.
  • Spouse and unmarried children under 21 years of age of legal permanent residents (sponsors with a “Green Card”).
